Injured on the road? Claim personal injury compensation.

Road accidents and injuries can be embarrassing and many of us don’t want to talk about them. This is a huge problem because injury compensation can be claimed in regards to most road accidents.  

 

Who can make a claim?

Have you, a friend, family member or colleague been injured on the road? Many of us are unaware that claims for compensation can be made if:

  • you were a driver, passenger, pedestrian or cyclist and were injured in a motor vehicle accident;
  • you were financially dependent on a close relative or de-facto killed in a motor vehicle accident; or
  • the other vehicle involved in the accident could not be identified or if it was unlicensed.

 

What if you were partly at fault?

It is natural to feel uncomfortable if you were partly at fault in causing an accident. It is very important to know that you can claim for compensation even if you:

  • were under the influence of drugs or alcohol;
  • did not follow road rules;
  • were not wearing a seatbelt;
  • were not wearing a helmet while riding a motorbike, scooter or bicycle; or
  • were riding unrestrained in an open-top vehicle.

It does, however, need to be established that a driver or owner of a motor vehicle (other than yours) was at least partly at fault in order to make a claim for compensation.

 

What if you were totally at fault or another party was not negligent?

It is uncommon for us not to feel guilty or ashamed if we have made a mistake and caused a motor vehicle accident. In these cases, the impact of shock and trauma often goes un-diagnosed and the negligent parties do not seek out assistance. Even if you were completely at fault or unable to establish the negligence of another party and you were catastrophically injured, you are still able to claim for compensation.
